Fee Policy
1. Introduction
Cabinet ExpertImmo has built its reputation on the technical excellence of its work and on absolute integrity. These fundamental principles apply with the same rigour to our fee policy, which is founded on transparency, clarity and a prior agreement.
As a Building & Real-Estate Expert accredited to the Courts and Tribunals of Madagascar and a long-standing member of CAREA (Compagnie des Arbitres Rapporteurs et Experts Agréés), the firm is bound by unwavering compliance with a strict professional code of ethics, which guarantees every client fair, justified and predictable treatment of engagement costs.
2. Types of engagement
Engagement fees differ fundamentally according to the legal framework in which the appraisal is requested. We therefore distinguish two main categories of engagement:
- a) Judicial engagements: these are engagements entrusted by a court order or judgment (pre-trial judge, Court of First Instance, Court of Appeal, etc.). In this framework, fees are not freely negotiated. They are set and governed by the magistrate's decision or by the legal taxation provided for under Malagasy civil procedure. The firm complies strictly with this, both for setting the advance and for the final settlement of costs and fees.
- b) Private engagements: these are engagements initiated by a private party (individual, business, bank, insurance company, notary, lawyer, etc.) outside any litigation framework imposed by the courts. Such engagements are systematically subject to a prior bilateral agreement, freely agreed with the client.
3. Pricing method for private engagements
Unlike a property transaction, expert appraisal is not a form of commercial brokerage. Our fees therefore remunerate in-depth intellectual work, proven know-how, investigation time, and the professional liability we assume on every signed report.
Our fees are determined on a bespoke basis, taking into account the following factors:
- The nature of the property appraised (bare land, commercial premises, industrial building, prestige residential property, agricultural estate, etc.).
- The legal and technical complexity of the file (examination of complex title deeds, joint ownership, expropriations, latent disputes, easements).
- The geographical area of the engagement and any associated logistical costs.
- The urgency of the engagement requested by the client.
- The purpose of the report (bank mortgage guarantee, inheritance partition, preparation of a merger or acquisition, contribution in kind).
- The overall time estimated for the investigation, site visits, comparative analysis and drafting of the detailed report.
Crucial ethical warning: No fee charged by Cabinet ExpertImmo is calculated in proportion to the estimated open-market or rental value of the property. This rule is the cornerstone of our independence. The expert must have no interest — whether direct, indirect or economic — in the financial outcome of their valuation.
4. Fee agreement
The relationship of trust with our clients begins with complete transparency. That is why, for every private engagement, a written fee agreement is mandatorily drawn up BEFORE any appraisal work begins.
This agreement constitutes the contract that binds us. It sets out in detail:
- The exact subject and scope of the engagement entrusted.
- The perimeter of the property concerned and the list of documents to be provided and analysed.
- The provisional schedule of operations and the deadline for delivering the final report.
- The fixed amount of the agreed fees or, where applicable, the pricing formula (time spent, etc.).
- The payment terms (generally a deposit due on signing the order, and payment of the balance on delivery of the expert report).
- Any foreseeable additional costs (search fees, administrative costs, travel to the provinces).
5. Free quote
As each situation is unique, no standardised price list can replace a tailored assessment. Every engagement request submitted to our firm is systematically met with a free quote, with no obligation on your part, prepared after an initial review of your file. This quote is valid for 30 days from the date of issue.
6. Travel expenses
Cabinet ExpertImmo operates throughout the national territory. For all engagements requiring travel outside the Antananarivo jurisdiction, the actual logistical costs (including transport, accommodation and meals) are rigorously assessed in advance. They are submitted for the client's approval and confirmed in the agreement before any work on site.
7. Confidentiality of financial terms
In the strictest respect of the confidentiality and professional secrecy that characterise our profession, the financial terms (quotes, agreements, invoices) agreed with each of our clients are strictly confidential. No pricing data relating to a specific file is disclosed to anyone outside the parties to the contract, our supervisory bodies, or upon court order.
