Cabinet ExpertImmo formally commits to protecting the personal data of its clients and interlocutors in accordance with Law No. 2014-038 of January 9, 2015 on the protection of personal data in the Republic of Madagascar, as well as its implementing decree No. 2023-1541. The supervisory authority competent to ensure the proper application of these texts is the Malagasy Commission for Informatics and Liberties (CMIL).

4. Purposes of Processing

Personal data processing by Cabinet ExpertImmo exclusively pursues the following purposes:

  • Respond to contact requests and correspondence.
  • Establish quotes and fee agreements prior to interventions.
  • Rigorously execute appraisal missions (judicial or amicable).
  • Maintain professional registers required by the ethics of CAREA (Company of Approved Expert Reporting Arbitrators).
  • Comply with our legal, accounting, and tax obligations.

Important: We make no commercial or advertising use of your data, nor any resale to third parties. Your data is not subject to any profiling or automated decision-making.

5. Legal Basis of Processing

In accordance with the provisions of Law No. 2014-038 (notably articles 6 to 13), the processing of your data is lawful and is based on:

  • Consent of the data subject, expressly collected when submitting the contact form.
  • Performance of a contract, within the framework of signing an appraisal agreement or pre-contractual measures.
  • Compliance with a legal obligation to which the Firm is subject (keeping registers, archiving judicial reports, tax obligations).
  • Legitimate interest of the data controller for the administrative management and proper functioning of the firm.

6. Recipients

The collected data is strictly intended for the following actors:

  • The staff of Cabinet ExpertImmo: Mr. RABENIMANANA Normand alone, or where appropriate, specifically authorized internal staff bound by a confidentiality obligation.
  • Competent jurisdictions: Strictly within the exclusive framework of judicial missions entrusted to us by order or judgment.
  • Consulting experts: Possibly appointed by the magistrate during the mission for an additional technical opinion.
  • Our technical service providers: Notably the website host, acting under a contract containing strict confidentiality clauses.

No personal data is transmitted to third parties for commercial purposes, to advertising partners, or to marketing platforms.

7. Retention Period

Your data is kept for periods strictly proportionate to the purposes mentioned:

  • Contact requests without follow-up: Kept for a maximum period of 12 months.
  • Files of completed missions (amicable appraisals): Kept for the legal duration applicable to professional archives, i.e., at least 10 years from the closure of the file.
  • Judicial appraisal reports: Kept in rigorous compliance with the deposit and archiving obligations incumbent upon the approved expert by the Courts and Tribunals.

8. Confidentiality and Professional Secrecy

Beyond the framework set by the legislation on the protection of personal data, the real estate expert approved by the Courts and Tribunals of Madagascar is bound by absolute and irrevocable professional secrecy. In accordance with the ethics governing the profession, no information, correspondence, document, or conclusion relating to a file, an appraised property, or a client is disclosed to anyone outside the strict framework of the mission (notably to the parties or the authorized court).

9. Security

Cabinet ExpertImmo has implemented the technical and organizational measures necessary to preserve the integrity and confidentiality of your data. These measures include in particular:

  • Encryption of communications on the site via the HTTPS/TLS protocol.
  • Implementation of security HTTP headers (such as HSTS, CSP) to prevent cyberattacks.
  • Secure local storage of the Firm's digital and physical archives.
  • Strictly controlled physical access to the professional premises.

10. Rights of Data Subjects

In accordance with the provisions of Law No. 2014-038, any data subject has the following rights regarding their data at any time:

  • Right to information.
  • Right of access, direct or indirect, to your data.
  • Right to rectification of inaccurate or incomplete information.
  • Right to object to processing for legitimate reasons.
  • Right to erasure (this right is exercised within the strict limits of professional secrecy and the imperative legal retention obligations incumbent upon the judicial expert).

The Firm commits to providing you with a response within a maximum period of 30 days.

11. Complaint to the CMIL

If, after contacting us, you believe that the processing of your data does not comply with the provisions of Law No. 2014-038, you have the right to lodge a formal complaint with the competent supervisory authority: the Malagasy Commission for Informatics and Liberties (CMIL).

12. Cookies

Our philosophy is to limit data collection as much as possible. The site does not use any tracking, profiling, or advertising cookies. Only technical cookies strictly necessary for the functioning of the site or the memorization of your language preferences can be placed on your device. These cookies do not require prior consent.

13. Changes to this Policy
